Research Project This project explores the regulation of European digital law, focusing on the compliance and accountability of major digital companies. It aims to analyze the limits of current regulatory approaches, which are often too sector-specific and slow in the face of rapidly evolving digital practices. Among the avenues envisaged, the project proposes examining the possibility of ex ante control of contractual instruments (such as general terms of use and privacy policies), before they come into force. This control, carried out jointly by several administrative authorities, would potentially enable a better assessment of the impact of new practices on various aspects, such as freedom of expression, competition or the protection of personal data. The project will seek to shed light on the relevance of this approach to more cross-sectoral and preventive regulation.
Activities Description of research activities: The post-doctoral fellow will be responsible for assisting the research director in the analysis of doctrinal proposals already formulated in the European Union on digital regulation and the compliance of contractual instruments (such as UGC). He will also conduct interviews with legal professionals and members of regulatory authorities, in order to gather practical perspectives and assess the feasibility of the research avenues envisaged. In the final phase of the project, he or she will contribute to the drafting of proposals for changes in the law, based on the results of the research.
Skills Qualifications/Knowledge: The candidate should have a specialization in European digital law or regulatory law. Solid experience and knowledge are required in one of these two fields, together with a sound knowledge of the other. Fluency in English is required, and fluency in another European language would be an asset.
Operational skills / know-how: The candidate must be able to carry out complex legal analyses, synthesize information effectively and write research reports. Experience in conducting interviews would be an asset.
Personal skills: The candidate must be able to work independently and rigorously.
Working Environment and Context Presentation of the component / research unit: The Centre de Droit Privé Fondamental has long supported research projects in a wide range of areas: personal and family law, property law and the law of obligations, procedural law, criminal law, private international law, the historical dimension of law, the philosophical dimension of law. It is now opening up to digital law.
Reporting relationship: The post-doc will work under the direct supervision of Professor Emmanuel Netter.
